Apostile

What is an Apostille?

Many countries are parties to the Hague Convention which abolishes the requirement of legalization for Foreign Public Documents and simplifies the procedure necessary for documents formed in one country to be used in another.

Documents issued in one country which need to be used in another country must be “authenticated” or “legalized” before they can be recognized as valid in the foreign country. This is a process in which various seals are placed on the document. Such documents range from powers of attorney, affidavits, birth, death and marriages records, incorporation papers, deeds, patent applications, home studies and other legal papers. The number and type of authentication certificates that you will need to obtain depend on the nature of the document.

 

The apostille must be affixed at the government agency in the country which issued the original document. An Embassy does not have the authority to affix an apostille to a foreign government's documents.

The Office of American Services continues to perform notarial services for those wishing to execute documents in the presence of a U.S. Consular Officer. The fee is $30.00, or the euro equivalent per initial signature/seal; each additional signature/seal provided at the same time in connection with the same transaction will cost $20 or the euro equivalent.

Notarials are available Tuesday through Friday between 9:00 a.m. and 1:00 p.m., except on American and French holidays, and on the first day following a public holiday. Please bring a passport or other photo ID (passport, carte d'identité, or driver's license) as a means of verifying your identity.


Apostille for documents issued in the U.S.

If you have a document which you want legalized for use in another Convention country, the Convention certification called an apostille must be affixed to the document by a competent authority. The apostille is a pre-printed form prescribed by the Convention.

 

PROCEDURE:

Since the authorities designated by the U. S. to affix the apostille can only attest to the validity of certain seals, it may be necessary for you to obtain some intermediate seals on your document, depending on the origin of the document, before the apostille can be affixed. There is no single U. S. competent authority to issue the Convention apostille. There are different authorities for documents originating in state and local jurisdictions, Federal courts and Federal government agencies. Contact the competent local authority who will affix the certification (apostille) on your document. Please see appendix B for a list of the competent authorities. If it is necessary for you to obtain some intermediate seals on your document before obtaining the Convention apostille, consult the appropriate state or federal authority listed. Hague “Apostille” Authentication Certificate:

Article 7 of the Convention provides for the use of a standardized authentication certificate called an apostille. A sample apostille certificate is provided in appendix C of this guide. The apostille consists of the following: 1) name of country from which the document emanates; 2) name of person signing the document; 3) the capacity in which the person signing the document has acted; 4) in the case of unsigned documents, the name of the authority that has affixed the seal or stamp; 5) place of certification; 6) date of certification; 7) the authority issuing the certificate; 8) number of certificate; 9) seal or stamp of authority issuing certificate; and 10) signature of authority issuing certificate.

U.S. Courts

Clerks and Deputy Clerks of the Federal Court System.

Fee: $5.00.

For the purposes of the Convention, clerks and deputy clerks of the U.S. Courts shall include the clerks and deputy clerks of the following: The Supreme Court of the United States, the Courts of Appeals for the First through the Eleventh Circuits and the District of Columbia Circuit, the United States District Courts, the United States Court of Claims, the United States Court of Customs and Patent Appeals, the United States Court of International Trade, the United States District Court for the District of the Canal Zone, the District Court of Guam, the District Court of the Virgin Islands, and the District Court for the Northern Mariana Islands.

New York authorities in Albany advise that documents issued in the nine down state counties are authenticated under the Convention by the New York City office. The nine down state counties are New York, Kings, Queens, Bronx, Westchester, Nassau, Suffolk, Rockland and Richmond. •  All birth and death records originating from the five boroughs of New York City (Bronx, Kings, Manhattan, Queens, Staten Island) must be certified together with a Letter of Exemplification by the New York City Department of Health, http://www.ci.nyc.ny.us/html/doh/home.html Bureau of Vital Records, 125 Worth Street, New York, NY 10013. The original document must then be presented to the County Clerk's Office in the county where the document was obtained to verify the signature on the Letter of Exemplification. The document can then be presented to the New York State Department of State for authentication.

•  All marriage records originating from the five boroughs of New York City (Bronx, Kings, Manhattan, Queens, and Staten Island) must be obtained from the Marriage Bureau, Municipal Center, 1 Centre Street, 2nd Floor, New York, NY 10007. Obtain a certified copy of the marriage certificate with an original signature of the City Clerk. The document must then be presented to the County Clerk's Office in the county where the document was obtained to verify the signature of the City Clerk. The document can then be presented to the New York State Department of State for authentication.
